User Agreement

By scheduling a lesson with Music Studio 333, Kira Gee, or any affiliated educators/entities provided by Music Studio 333, (Further referred to as “educators,”) the student or, in the case of a student under the age of 18, the legal guardian (Further referred to as “client,”) confirms their agreement to the following terms.

  1. Unless the client was a student of the educators prior to September 16th 2024, they agree to pay the full amount due for the lesson (viewable on the pricing and scheduling page) upon scheduling, prior to the event. This is considered non-refundable, and will not be returned due to scheduling conflicts by the client. If such a conflict does occur, and there are open appointment spaces within a seven day period, the lesson can be rescheduled for free within a 7 day period as long as at least 3 hours advanced notice is given.
    1. If no educator is available for the client’s scheduled lesson, and the client is not able to reschedule, then a full refund shall be granted within 10 business days.
      1. Music Studio 333 has a qualified list of instructors that they will contract with if deemed beneficial to the client. The educators are subject to change and the client will be notified at that point. If an educator is unable to attend a lesson, Music Studio 333 will attempt to find a qualified alternative.
        1. Educators will take detailed notes to ensure a continuous high quality education.
    2. The payment will be submitted through the scheduling portal.
      1. All payments will be processed by PayPal.
    3. If a recurring client is temporarily not able to pay with card, a one time acceptation will be granted and a cash payment will be accepted at the beginning of the lesson with prior approval.
  2. The educators agree to travel to any location within the metro phoenix area for the service referred to as the private traveling studio (Private lesson/s), however, the educator reserves the right to change the location of the private lesson or reschedule to a virtual lesson as they, or our team deems fit. Potential reasons for a location change include;
    1. A lesson location deemed potentially unsafe by either the educator or our team
    2. A distance from the location of our educator that would require over an hour of travel between the educator’s location and the client’s
    3. Transportation issues from the educator
    4. Any other reason the educator could not reasonably be expected to travel to the client’s chosen location
  3. Due to the inerrant safety risk connected to being an educator traveling to various locations, our educators have the express right to cancel a lesson without refund if they feel unsafe at any time after the lesson is scheduled. To mitigate safety risks, we have the right to run background checks on all clients.
    1. Background checks will be handled by Checkr. 
    2. We value privacy, so we do not store any information related to the background checks, however we do store a copy of the client’s ID for identification purposes.
    3. We do not discriminate against any group, including felons, however if the results of a client’s background check creates concerns of safety amongst the educator or any member of the team, the lesson will be canceled without refund. Neither the educators, or our team will be required to disclose the reason of cancelation if it is related to a safety concern.
      1. A legal standing of a client that includes any charges related to a violent crime or sex offense will lead to immediate termination of any scheduled lesson/s and a permanent ban from working with our educators.
        1. We absorb the cost of the background checks, however if such an offense keeps us from continuing our lessons, the cost of the check will be billed to the client. For no other reason will a check be billed to the client.
  4. Prior to any continuous private lesson, a 20 minute free lesson and onboarding session between an educator will occur. This is required to determine the learning style of the client, set goals, and ensure identity.
  5. During virtual lessons, including the 20 minute free lesson, we ask that the client has a functional webcam that will remain on for the full lesson and a quiet environment to practice in.
    1. If the client is not able to meet these requirements for their free first lesson, then an educator will meet the client at their location for a $20 surcharge. Terms to in person meetings still apply.
    2. If the client is unable to meet these requirements after the first lesson, and the educator deems a virtual lesson necessary, then the lesson will either be rescheduled or refunded.
  6. Upon scheduling the client’s 20 minute free lesson, they will be asked for a photograph of the front and back of their government ID. If this is not provided, the lesson will be canceled. If the person present at the 20 minute lesson does not appear to be the person the client provided their ID, the lesson will end and all further lessons will be canceled as, as we will not be able to confirm the identity or complete a background check.
  7. If any conflicts arise, the client agrees to settle the dispute through an arbitrator that will be mutually selected and agreed on at the time of the dispute. If parties can not agree on an arbitrator within 30 days after the conflict arises, it will be selected by an arbitration institution chosen by Music Studio 333.
  8. If a client is not at their set location for a private lesson within the first 15 minutes, and does not communicate their arrival time with the educator, it will be cancelled without refund. If the client notifies the educator at least 30 minutes before the scheduled lesson time that they will be late, they will be able to reschedule for a time in the next 7 days free of charge.
  9. If a client does not arrive at a group lesson at the scheduled time, regardless of prior notice, they will not receive a refund. We encourage our clients to reschedule within three hours of their lesson to avoid missed time.
    1. If a client arrives more than 15 minutes late, they are welcome to ask our educator what they missed and pick up partially through the lesson
  10. Group lessons will have a minimum attendance of two clients, if the minimum attendance is not reached for a scheduled day, the client will have two options, either accept a refund, or convert their lesson to a private lesson at no extra charge.
  11. Group lessons will have a maximum of 15 attendees. If the group lesson surpasses this amount, an additional class for that date will be added and clients will be reassigned accordingly. If any client is unable to be rescheduled for a different time that day, we will make every reasonable attempt to move other clients. If this can not be done, the lesson will continue at it’s 15 member member maximum and the first 15 clients to sign up will be prioritized. All other clients will be rescheduled or refunded.
  12. Group lessons will be a safe space for all clients. If a client causes a disturbance that threatens to make anyone feel uncomfortable, that client will be ejected from the lesson. If said client refuses to leave, they will be considered to be trespassing and emergency services will be called to eject that client. No refund will be granted.
  13. Music Studio 333 aims to be inclusive to clients with learning disabilities, therefore our educators will be instructed to refocus students in the event of a non-threatening disruption. If the disruptions are continuous, and begin to distract other clients from their lesson, they will be asked to leave, or if they are under the age of 18, their parents or guardian’s will be contacted.
    1. If this is related to a learning disability, and this is the first occurrence, the client will be rescheduled to a private lesson free of charge where they will receive specialized treatment, and will be encouraged to seek private lessons from there on.
    2. If the client returns to a group lesson and this occurs again, we reserve the right to only make private lessons available to them so we can ensure they are getting the attention they require to learn.
  14. Music Studio 333 and all educators are waived from liability in case of accidents or injuries during lessons.
    1. The client acknowledges and accepts the inherent risks associated with music lessons, including but not limited to potential physical strain or injury.
    2. The client is responsible for creating a safe environment for the educator and themselves, as well as following instructions from the educator. This is the best way to ensure safety.
  15. If an educator creates an original material for the purpose of the lesson, it will be considered their sole intellectual property. The client will retain all intellectual property rights of any original materials created with assistance from an educator, while granting the educator limited use of said materials for marketing purposes. 
  16. If any unforeseen events that can be considered considered a force majeure event, (e.g., natural disasters, pandemics) prevent lessons from taking place, the client will either be able to reschedule to virtual lessons during the length of the event, or temporarily pause their appointments until the end of the event. If the appointment is paused, a refund will not be given, unless either party is deemed unable to continue their lessons for the foreseeable future. This applies to both private and group lessons.
  17. All learning materials and any other sensitive information shared during lessons, such as personal details or goals that are used by Music Studio 333 are considered their intellectual property and the client agrees that they will be kept confidential.
    1. The client also agrees not to compete with Music Studio 333 using our proprietary teaching methods.
  18. This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles.
